Waiver and Release of Liability Agreement

This is a liability release, please read carefully before agreeing to its terms.

1.1 You as a participant of this presentation, for yourself and your heirs, assigns, executors, administrators and successors and each of them, hereby releases and forever discharges Purpose Over Profit LLC (DBA Love Jays), their subsidiaries and/or parent corporations, affiliated businesses, as well as divisions, affiliates, past and present officers, owners, predecessors, directors, employees, agents, shareholders, fiduciaries, representatives, attorneys, insurers, benefit plans, private investigators, DBA’s and each and all of the foregoing persons’ heirs, assigns, executors, administrators and successors, or any of them, or anyone claiming by, through, under or on behalf of any of them (hereinafter “Released Parties”) of and from any and all claims, demands, actions and causes of action, in law or in equity, suits, liabilities, losses, costs or expenses, known or unknown, suspected or unsuspected, that you now have or may have against Released Parties arising out of, or in any way connected with the occurrences, affairs, and transactions between the Parties from the beginning of time to the Effective Date of this Agreement, whether or not asserted before the Effective Date of this Agreement, including, but not limited to, all claims for negligence, breach of contract, breach of implied covenant of good faith and fair dealing, fraud, misrepresentation, intentional and negligent infliction of emotional distress, any and all claims under the California Business and Professions Code, and California Civil Code or similar laws of any other jurisdiction, and all claims raised or which could have been raised as of the effective date of this Agreement.

1.2 You understand and agree that the released claims include not only claims presently known to you, but also include all unknown or unanticipated claims, rights, demands, actions, obligations, liabilities, and causes of action of every kind and character that would otherwise come within the scope of the released claims, as described in Section 1.1.

1.3 You understand that you may hereafter discover facts different from what you now believe to be true, which if known, could have materially affected this Agreement, but you nevertheless waive any claims or rights based on different or additional facts. You knowingly and voluntarily waive any and all rights or benefits that you may now have, or in the future may have, under the terms of Section 1542 of the California Civil Code, which provides as follows:

1.4 The Parties hereto represent and warrant that they have the authority to enter into this Agreement on their own behalf and to bind all persons or entities who may claim through them.

1.5 Should any court of competent jurisdiction determine that any term or provision of this Agreement is unenforceable, such term or provision shall be deemed to be deleted as though it had never been a part of this Agreement, and the validity, legality and enforceability of the remaining terms and provisions shall not be in any way affected or imperiled thereby.

1.6 This Agreement shall be construed in accordance with the laws of the State of California.

1.7 All covenants, agreements, representations and warranties made in this Agreement, as may be amended by Purpose Over Profit LLC at a given time, shall survive your acceptance of this Agreement and the termination of this agreement. I hereby acknowledge that I have read the aforementioned “Disclaimer and Release of Liability Agreement” in its entirety and fully understand all of its terms and conditions. I further understand that by participating in this presentation I agree to assume financial responsibility for all risk of potential harm suffered as a result of utilizing any of the information shared in the “15 Must Have Conversations Before Saying I Do” presentation.
